General Conditions of Use
ZANZOODLE shopping cart is provided by studiosix creative corp. All users of the ZANZOODLE shopping cart ('Account Holder') (including any employees / agents of Account Holders) agree to abide by the terms and conditions set out below. ZANZOODLE reserve the right to suspend, restrict or terminate any Account where the Account Holder is (or may be) in breach of these terms and conditions. Your use of the ZANZOODLE shopping cart indicates your acceptance of these Terms and conditions.

Provision of ZANZOODLE Accounts
ZANZOODLE Accounts are provided on for a monthly fee plus a percentage of each sale depending on which program you choose. Each of these businesses or charities may have as many ZANZOODLE Accounts as required, providing they are used exclusively with that account. ZANZOODLE accounts are set-up for a 1 year time frame. Each program can be changed every 6 months.

ZANZOODLE reserve the right to refuse service to any individual or organization for any reason.

Use of ZANZOODLE Accounts
ZANZOODLE Accounts are to be used only by the Account Holder and/or his/her appointed staff, including web developers / web designers / webmasters or any contracted staff or companies. All ZANZOODLE Accounts must remain in total control of the Account Holder. Account Holders will ensure that their employees / staff abide by the ZANZOODLE Terms and Conditions.

Each ZANZOODLE Account may be used with multiple websites if required, but all websites must be the property of the Account Holder. Account Holders must not resell or give away use of the ZANZOODLE shopping cart to other parties.

Prohibited Use
ZANZOODLE prohibit the use of the ZANZOODLE shopping cart for:

* Illegal material, such as commercial audio, video or music files or any other copyrighted works, for which the account holder does not have the permission of the coyright holder, or any other material in violation of US Law
* Pornography, erotic images or otherwise lewd or obscene content
* Racist, defamatory, obscene, indecent or other unlawful material
* Pirated software, ROMS, emulators, instructions or software for phreaking, hacking, password cracking or IP spoofing etc
* Sites engaging in illegal activities
* Products or sites being promoted by spam (unsolicited email)

ZANZOODLE reserve the right to determine in our sole disctretion whether any material or use is prohibited. ZANZOODLE reserve the right to suspend or terminate any ZANZOODLE Account without warning and without refund or notice.

Spam (unsolicited email)
ZANZOODLE prohibits spam (the sending of unsolicited bulk email) and the promotion of websites by spamming. ZANZOODLE will terminate any ZANZOODLE Account, without refund and without notice, for which the Account Holder has sent spam (unsolicited "bulk" / "commercial" emails).

ZANZOODLE reserve the right to determine in our sole disctretion whether any particular emails are or are not spam.

Cancellation / Refunds
Account Holders may cease using the ZANZOODLE shopping cart at any time. If an Account Holder no longer requires their ZANZOODLE Account, the Account Holder must notify ZANZOODLE, preferably by email, that the ZANZOODLE Account is no longer required.

For those Account Holders paying for ZANZOODLE Accounts, the minimum billing period is three months. Payments will continue to be collected until such time as the Account Holder requests cancellation. No refunds will be made for unused parts of a billing period. No refunds will be made for the Account Holder's failure to cancel their ZANZOODLE Account.

ZANZOODLE accounts are for a timeframe of 1 year. Cancellation of service must be sent via email.

Non-payment will, at the sole discretion of ZANZOODLE, lead to suspension of services and/or cancellation of Accounts. Account Holders will remain liable for any unpaid periods up to the date of cancellation.

Disclaimer of Warranties
The ZANZOODLE shopping cart is provided "as is" and "as available" and without warranties as to performance or merchantability, or any other warranties whether expressed or implied, including (but not limited to) the exclusion of warranties of title, merchantability, satisfactory quality, fitness for a particular purpose and non-infringement of proprietary or third party rights.

ZANZOODLE make no warranty that the use of the ZANZOODLE shopping cart or the results that may be obtained from using ZANZOODLE Accounts will meet your requirements or be acceptable to you, or that the service will be uninterrupted, timely, secure, or error free.

No advice or information, whether oral or written, obtained from us by you or through or from the service shall create a warranty of any kind.

Liability
You expressly understand and agree that ZANZOODLE, it's employees, agents and contracted staff or companies will not be liable for any direct, indirect, incidental, special, consequential or expemplary damages, including but not limited to damages for loss of profits, goodwill, use, data or other intangible losses (even if we have been advised of the possibility of such damages and losses), resulting from the use or the inability to use the services, the cost of procurement of substitute services, unauthorised access to or alteration of your transmissions or data, statements or conduct of any third party, any other matter relating to this website or the services.

Jurisdiction
These Terms and Conditions shall be governed by the Laws of the United States of America which shall claim venue and jurisdiction for any legal motion or claim arising from this agreement.
